I wonder if the offer to have his salary reduced constitutes constructive dismissal? Litigation against the driver of the car he was in too for loss of earnings might be on the cards.

Not sure what you mean by this. I don't think there is any other way you can drive home without intent. As it happens DD is strict liability so there is no mens rea component.

No knowledge of employment law but i'm not sure you could have constructive dismissal when there has been an actual dismissal?
